CUSTOM TERMS:
“Synthetic Vocal Performances”: recorded audio output of the “Program” generated from a unique End-User-supplied input consisting of multilingual text, dynamic musical information and various inflection or other tonal altering parameters.
“Vocal Parameter Database”: a complex set of encoded numbers representing the unique vocal tract characteristics, formants and mouth movements of a simulated voice.
Please read the terms of the following software licensing agreement before using it.
By installing and loading these products on your computer you acknowledge that you have read this license agreement, understand the agreement, and agree to its terms and conditions. If you do not agree to these terms and conditions, do not install or use the audio software herein.
This is the complete agreement between you and Plogue Art et Technologie, Inc that supersedes any other representations or prior agreements, whether oral or in writing. You are obtaining a license for your use only – the Program and its “Vocal Parameter Database”s DO NOT BELONG TO YOU. You may not adapt or make alterations to the “Program”, decompile, disassemble, translate, convert to another programming language or otherwise reverse engineer the “Program”. The installation, or use of the “Program” does not transfer to you any title in the intellectual property in any “Vocal Parameter Database” contained herein , and you will not acquire any rights to the “Vocal Parameter Database” except as expressly set forth in the Agreement.
You can use “Synthetic Vocal Performances” for music productions (albums/singles), for video game scores, public performances, or other reasonable musical purposes within musical compositions as you like without any need to pay Plogue Art et Technologie Inc. or obtain further permission as long as you adhere to all of the following rules: You may not publish or distribute or publicly perform in any manner “Synthetic Vocal Performances” that contain lyrics which are against public policy, are obscene, pornographic, hateful, abusive or otherwise objectionable. You may not publish or distribute in any manner “Synthetic Vocal Performances” for use as built-in voice inside a commercial consumer electronic device, commercial software product or commercial online service or any other hardware or software products without prior written agreement with Plogue Art et Technologie, Inc. You may not re-use “Synthetic Vocal Performances”'s in any other commercial sample library or any competitive product even if they are edited, modified, digitally altered, re-synthesized or manipulated in any way (derived work).
You are absolutely forbidden to duplicate, copy, distribute, transfer, upload or download, trade, loan, reissue or resell this “Program” or any of the contents in any way without direct written consent of Plogue Art et Technologie Inc. You agree to release, hold harmless and forever discharge “Alcatel-Lucent”, Microchip Technology Incorporated, Texas Instruments, Dr. Forrest S. Mozer, Dennis Klatt's Estate and their agents, employees, officers, directors, affiliates, successors and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages or liabilities, of any kind or nature, whether known or unknown, in law or in equity, that Licensee ever had or may have, arising from or in any way related to the use of the “Program”.
We kindly ask that in any written materials or credits accompanying your music or sound design that utilizes material from Plogue chipspeech (CD booklet, film, game credits, etc), that you include the following courtesy credits: "Some Synthethic Vocal Performances were made using Plogue chipspeech, or a similar credit where practicable. If you can't disclose to the general public, your use of chipspeech for any reason, Plogue would nevertheless like to be made aware of the usage of chipspeech in for its own PRIVATE records. You agree not use the names “Plogue chipspeech”, “Alcatel-Lucent”, Microchip Technology Incorporated, Texas Instruments, Dr. Forrest S. Mozer, Dennis Klatt's Estate for any promotional purposes, product package or advertisement. Disclaimers and Conditions A right to use Plogue chipspeech is granted to the original end-user only, and this license is not transferable unless there is written consent of Plogue Art et Technologie Inc and possible payment of an additional fee. The Vocal Parameter Databases of Plogue chipspeech will only work with the bundled Plogue chipspeech Player and will not work with any other software. Licensor will not be responsible if the content of this software does not fit the particular purpose of the Licensee. Please make sure before ordering this item that it meets your needs. Information contained herein is subject to change without notice and does not represent a commitment on the part of Plogue Art et Technologie Inc. The software is licensed "as is" without warranties of any kind. You may terminate this Agreement at any point by destroying all copies of the Software and the Documentation. 3. Ownership Rights. The Software is protected by copyright laws and international treaty provisions. PLOGUE ART ET TECHNOLOGIE own and retain all right, title and interest in and to the Software, including all copyrights, patents, trade secret rights, trademarks and other intellectual property rights therein. Your possession, installation, or use of the Software does not transfer to you any title to the intellectual property in the Software, and you will not acquire any rights to the Software except as expressly set forth in this Agreement. 4. Restrictions. You may not rent, lease, loan, sublicense or resell the Software. You may not permit third parties to benefit from the use or functionality of the Software via a timesharing, service bureau or other arrangement. You may not transfer any of the rights granted to you under this Agreement. You may not reverse engineer, decompile, or disassemble the Software, except to the extent the foregoing restriction is expressly prohibited by applicable law. You may not modify, or create derivative works based upon, the Software in whole or in part. All rights not expressly set forth hereunder are reserved by PLOGUE ART ET TECHNOLOGIE. 5. Warranty and Disclaimer. Except for the limited warranty set forth herein, THE SOFTWARE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLOGUE ART ET TECHNOLOGIE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION.
